Unforeseen Trouble for Harrah's

Though Harrah’s Entertainment had a successful summer with the near-completion of their US World Series of Poker in Las Vegas, Nevada, the fall may turn out be less optimistic if rumors among online gambling websites turn out to be true. The land-based casino operator, who now has internet gambling operations in the UK, has launched their most recent promotion only to find out that it could well put them in some legal trouble.

A New Jersey Superior Court order has been issued in relation to the Harrah’s promo, that could affect as many as 350,000 gamblers. According to a press released from the legal group Galex Wolf LLC claims that gambling members who associate themselves with Harrah’s could find themselves dragged into the case, called as class members in a case developing against the gambling firm, which is facing charges that they violated New Jersey advertising laws. Eighty thousand of the players have been advised that they will be awarded $100 each for their cooperation.

If the court can prove that they also suffered damages in relation to Harrah’s actions, they could also receive payment. Technically speaking, the case being heard is Debra Smerling versus Harrah’s. It revolves around the casino group’s promotion called ‘Birthday Cash;’ Harrah’s Entertainment offered up $15 cash reward to all of their Total Rewards card customers on their birthday, all redeemable at the Atlantic City casino.

The court’s ruling was not found in Harrah’s favor, as the Superior judge decreed that the casino group violated state laws by stipulating specific dates on which the coupons could be redeemed, without stating on the disclosures that the casino would not honor the slips after midnight, or before 6am on their players’ birthdays. Smerling tried to do just that – she attempted to cash in the coupon at 12:30am on August 10th of 2003, and was turned away, as the casino claimed it was not yet applicable. As Ms Smerling did not intend to stay at the casino until the 8am reopening, she filed the lawsuit – and to the amazement of the witnessing internet gambling community – has won. No statement has yet been made from the Harrah’s group regarding the case.
