Yet another update has become available
in relation to the online gambling laws in China, where this week the
authorities have reportedly updated the guidelines to better assist in
police’s efforts to eradicate all illegal gambling from the nation. The
nation has been very public about their renewed efforts since January to
stamp out internet gambling on the mainland, and in the most recent weapon
of choice in that endeavor are new legal guidelines, developed for
criminal law and based on the police’s experiences over the last 9 months
of the year. The changes were first finalized by the Supreme People’s court, the Supreme People’s Procurator and the Ministry of Public Security before being released and published by the online gambling news presses. The goal of the project was to clarify without doubt the laws in regards to internet gambling, leaving supposedly no room for legal loopholes out of which gamblers and operators could squeeze themselves. According to a report by the Xinghua news, anyone who runs or launches an illegal gambling operation in China can do so with the expectation of up to three years in prison and additional fines and penalties. For larger schemes and more serious cases, their jail time can increase to up to ten years. Even further, the definition of the crime has been written as an involvement in any location that establishes or hosts betting on a website, takes bets, or facilitates others to place bets on online casino sites. Even acting as an access point or agent for the sites’ operators comes under penalty of law, even more so if a location takes a cut of profits. Though all these now constitute ‘establishing or running a gambling house,’ there are further definitions for things such as ‘serious internet gambling crimes,’ where the host’s total commissions top out over 30,000 yuan or the total gambling volume is more than 300,000 yuan. ‘Serious’ also applies to having more than 120 customers, or shared profits coming in at more than 30,000 yuan. Even those not establishing a location will be prosecuted, such as agents that receive or pay out bets, or solicits youth to gamble. |
