The case of the Wynn dealers versus management regarding distribution of tips has been dismissed from the Nevada Supreme Court with no ruling. The Court decreed that it was not of their jurisdiction to decide, and directed the lawsuit to the office of the Nevada Labor Commissioner.

The issue began in 2006, when the management of the Wynn casino and resort in Las Vegas introduced the new policy that pit bosses would share in the tips given to dealers by casino patrons. At the time, the casino said that it was in line with the effort to get management involved more directly with the players on the floor, but since it’s become clear that the practice allows Wynn to keep its salary costs down, while keeping pit bosses happy. The dealers, however, have experienced up to a 20% drop in their income, having to now share it with those who already earn salary. Whereas to keep their overhead down, Wynn had been reluctant to raise wages, forcing dealers to share their tips help management with the growing disparity between the two.

One of the dealers who helped put the lawsuit together, Daniel Baldonado, made the observation that if Wynn is allowed to continue the practice, it will soon spread to other casinos. He said that other casinos are holding off only so long as to see the results of the court case.

They’ll have to wait a bit longer, as the case has not been decided; only redirected.
One of the lawyers on the plantiffs’ side, Leon Greenberg, said, “No determination was made as to whether the Wynn tip policy is illegal or proper under Nevada law.”

Of interest as well, has been the sudden growth in support of union representation since the beginning of the proceedings. Whereas Wynn had a relatively strong reputation as a good employer, the Transportation Workers Union of America has found that a vote for organized labor came to three-to-one in favor of unionizing.
