More drama in the online gambling world is erupting out of the Australian Outback this month, as demands for the return of a gambling device have been filed by the owner and operator of the machine, a lawsuit filed against the Victorian Commission for Gambling. The machine has been identified as a VenueNet machine, owned by the developers. It was seized in a raid last year on a small pub in Melbourne, though no charges have been filed against VenueNet for it’s operation.

Eight months is enough, says VenueNet, which has filed its own lawsuit against the Commission, demanding the return of the machine. Though the prosecution has claimed that the machine is a ‘gambling device,’ they are having a hard time proving it as the computer itself does not take bets, store wages, or track bankrolls. Rather, it is an internet access point developed by VenueNet on behalf of their internet casino clientele, such as Sportsbet.

According to a report by the Sydney Morning Herald, the kiosk was designed to provide access to the Sportingbet online casino, and facilitate use of their internet gambling services over the web. Sworn statements have been issued to prove to the court by the manufacturers that the hard drive included in the kiosk are no different than other internet access points they’ve developed. Players can simply access existing Sportsbetting accounts to play, but the machine itself cannot be deemed a gambling device.

It is believed that Tabcorp, the sole company with exclusive gambling rights for retail pub betting is a major powerhouse for the case, which once resolved could set an interesting standard for online gambling in Victoria. VenueNet continues to maintain that the delays are costing them millions of dollars; they are considering pursuing compensation for the lost profits in addition to the return of the kiosk. But until it can be resolved, all plans to install similar machines throughout Australia have been placed on hold. ''I think we'd face something like this [again] until this is resolved. Everyone's focusing on this,” said VenueNet chairman, John Thompson.
