The goal will be not only to determine what exactly was purchased with the cards, but from whom and where the transactions originated, as well as the physical location of the user at the time of the use. Banks, and credit card companies have so far been able to agree on one thing: they have no enthusiasm for their new responsibilities, and the vast majority believe that the costs in man power and currency alike will not be worth it. A final complication comes with the location of the servers used to operate an online casino. The best example comes from a long-standing case between the Piggs Peak Casino in Swaziland, and South African authorities, as the Casino maintains that use of their site doesn’t constitute illegal gambling in South Africa since their servers are located outside of the country and players are able to stream Flash media games without ever downloading. Since the games, the software, and the casino itself are all located outside of SA’s borders, Piggs Peak says they are outside of the litigation’s jurisdiction. |
