Harrah's Responds to Ultra's Allegations

The largest gambling group in the United States is on the defensive this week, as Harrah’s Entertainment responds to allegations made by Ultra Internet Media SA that they breached an online poker contract. Ultra, the owner of Everest Poker’s internet gambling brand, launched litigation just last month in a Las Vegas Courthouse, claiming that a logo display agreement had been violated by Harrah’s World Series of Poker last year. Harrah’s has responded to the accusations, defending themselves unequivocally.

The contract under question was for last year’s World Series of Poker, which carried with it a $22.5 million sponsorship agreement between Everest Poker and the WSOP table logos. According to the allegations, when the Series was broadcast by an ESPN affiliate in Europe (the television network RTL9), the Everest logo was swapped out with a brand icon for Full Tilt Poker, a competitor in the online gambling industry. The Tournament featured the switch for the French broadcast only.

Harrah’s doesn’t actually dispute the logo switch for the broadcast, but instead is adhering to those agreements made within the original contract. According to the powerful firm, which entered into the online gambling world themselves just last year, the agreement made with Everest was purposed for further exposure to the American audiences, and made no stipulations about the logo being displayed to French audiences. They claim to be wholly within their rights to have electronically made the logo switch for the European broadcasts. In addition, claims the Harrah's response, Harrah's agreed Everest Poker would be described as the presenting sponsor of the WSOP during the broadcasts in certain European countries, but not France.

"Nobody from Harrah's made any representation during any of the negotiations or in the promotional agreement concerning any ESPN distribution or WSOP programming in France," the Harrah's filing claims. "In 2008 and 2009 the WSOP was broadcast by ESPN and parties with whom it has contracts in over 170 countries, including the United States, collectively to over 250 million households, for over 6 000 hours. Thus, UIM has certainly gained all the exposure for the everestpoker.net website that it could have hoped for, and more.”
