continued from Surprise Kentucky Ruling - 2 The case has now been returned to the lower court of appeals to start over again. iMEGA noted that they have 20 days to re-file with the appellate court, and affirmed that the issue will likely find its way quickly back to the Supreme Court. Joe Brennan said in his statement to the presses that they will likely only need to name one of their members to meet the requirement for organizational standing, so it’s just a question of which online gambling firm steps up. One other group has been very supportive in the defense of the internet casino domain names, though they didn’t quite join the legal team. The Poker Players Alliance (PPA) is consistently supportive of nearly all issues that could result in the legalization and liberalization of the online gambling industry in the US. With one million members and a very active voice on the lobbying front to members of Congress, the PPA is a strong ally to have in rallying support for any case, and they released a statement promptly after the news broke regarding iMEGA’s loss in the Supreme Court. "The PPA understands the technical nature of the decision issued today by the Kentucky Supreme Court and remains confident that, once that issue is cured,” said John Pappas, the group’s executive director, “the Supreme Court will address the compelling merits of the arguments in support of the Court of Appeals decision prohibiting the Commonwealth's seizure of 141 internet gaming sites.” The PPA’s position is that what might seem like a localized win for Governor Beshear is not the case at all; Pappas said that fundamental freedoms needed to be considered, with the effects of the Kentucky case spreading much further to other corners of the online casino industry. Should Kentucky win, and be able to seize rights to international website domain names, the ruling could set a very dangerous precedent for anyone who uses the internet. |
