It’s well-known throughout the internet gambling world that Europe is often the hotspot for change when it comes to regulatory standards, but internet casinos will be able to rest well this week after the release of the two latest legal opinions at the European Court of Justice. According to the opinions, the Advocates General at the Court continue to uphold an impartial approach to all of its official recommendations, including this weeks, which take a closer look at the legality of monopolistic online gambling structures on the continent.

Advocate General Mazak made his stance clear enough with the publication of his questioning of the pervasive standards accepted by Austria. Austria is one such nation that continues to not only allow but encourage a monopolistic structure for internet casinos, as the law dictates that companies wishing to do business with Austrian residents must be based out of and physically present within the Austrian borders. Advocate General Mazak called it a rule that “….is a clear example of direct discrimination against companies who are seated in another member state.” Austria is a member of the European Union and should theoretically be held accountable to the open trade laws agreed to among fellow member states.

Advocate General Mazak developed his view in response to a question of legality for Casinos Austria, the monopoly gambling group. The case of Ernst Engelmann (C-64/08) is currently being taken under consideration by the Court of Justice. While the overall permission given to Casinos Austria is by far and large outside the legality of European Union law, there are other issues to be dealt with as well. Because of the online gambling industry’s structure within Austrian legislation, licenses in the gaming sector must be dealt with in a public and transparent manner, something the firm also seemed resistant to.
