The date of June 1st has a number of reasons to be significant for the online gambling community, and not just in the United States. In fact, though the date was chosen to be the official enforcement date for the Unlawful Internet Gambling Enforcement Act of 2006, few reports on its institution have come from American authorities, calling into question what changed on the fateful day. Supposedly, financial companies – including credit card firms as well as banks and credit unions – may now be held liable for those transactions processed linked to offshore and illegal online gambling sites. Though it would be quite logistically impossible to prosecute American players signing into online casinos every day, the transactional side is now quite illegal, holding the already recovering financial sector of the US economy responsible for detecting such transactions, though conveniently, the government has failed to provide definitions of what is considered ‘legal’ versus ‘illegal’ when it comes to internet gambling. Meanwhile, similar nightmares are unfolding across the Atlantic Ocean, as Norwegian players are having to make similar shifts. The members for the world renowned online gambling group Ladbrokes were notified months back that a legal shift would prevent them from accepting credit cards and financial data linked to Norwegian banks. The date of enforcement coincides with that of the UIGEA, as June 1st of this year. The change had, admittedly, been seen coming for years, as the Norwegian government struggled to find a means to accommodate demands being made by the European Commission to comply with free trade laws pertinent to their membership in the European Economic Area, and continue to facilitate success for their gambling monopoly Norsk Tipping. Litigation took months, delaying the decision, which was finally made in February of this year, with the Payments Act. The similarities between the Payments Act and the UIGEA in the US are stark, effectively moving to halt financial transactions between Norwegian residents and offshore online gambling websites. |
