In an argument that will likely never end, the issue of luck versus skill is scheduled to be back in South Carolina’s courts this month, as the case from four years ago is scheduled to appear before the Supreme Court. According to local news, the Mount Pleasant case, well known to online gamblers for its sheer ridiculousness, will be reconsidered, as the remaining five defendants take their pleas to the highest state court possible, claiming that their practice was fully within the bounds of the law as the game of poker is a game of skill, not luck. The case originally broke in Mount Pleasant four years ago, when police crashed a private party to arrest a group of friends and neighbors playing poker. Most of those detained by officials plead out, guilty, with adjusted punishments, with only the remaining five defending their right to play a skill-based card game in the sanctity of their own home. The point of ‘skill’ is what has made all the difference in the world, and getting larger bodies involved in the small town issue. Because poker has been defined in some locations and cases as a game of skill, not luck, as other online gambling would be, its is permittable and playable under South Carolina law. The local city court disagreed. So they appealed higher. There they won, catching the approval and ruling of Judge Markley Dennis, who ruled that the game of Texas Hold’Em was in fact a game of skill. It was news for all of the internet gambling industry to celebrate, and giving credence to similar cases elsewhere in the US. Unfortunately, the prosecutors for the state of South Carolina continued to disagree, and their appeal will now see the case to the Supreme Court. The date for the case to be heard has yet to be set, though most internet gambling analysts expect it to take place before the end of the year. Since the start, the case has caught the attention of the Poker Players Alliance, one of the most influential gambling bodies in the US, who undoubtedly hope to use the case as an example for other circumstances, and back their lobbying efforts on a national level. |
