The US legal system was in full swing and the online gambling industry celebrated late in the year, following a court decision that overturned the conviction of five poker players in 2009 for their participation in what the authorities deemed ‘illegal gambling.’ Despite the continued arguments surrounding whether poker – in both online casino and live games – constitutes as a game of skill or a game of chance, the courts in states all over America continue to independently debate the issue, sending poker players time and time again back to court for appeals and reversals of rulings. Though the five from South Carolina are off the hook for now, the celebration could very well be short-lived as the Attorney General for South Carolina has pledged to take the case back to court to appeal the most recent decision, determined to send the “criminals” to jail for their card playing. Henry McMaster, Attorney General, submitted an official appeal with the South Carolina Supreme Court late in December, immediate following Circuit Court Judge Markley Dennis’ decision that poker was actually a game of skill, that participating in poker was not considered illegal gambling, and that the five players’ records be absolved of their ‘crime.’ He also criticized the state’s definitions for gambling, calling the classifications “unconstitutionally vague and over-broad.” The Charleston Post reported that McMaster’s appeal said, "Our obvious reason that 'chance' need not be determined with respect to a particular game for purpose of the gambling statute is that the legislature sought to ban all 'gaming' for stakes at designated locations.” |
