New Twist from Beshear's Team

For two years the online gambling industry has looked on as Governor Steve Beshear of Kentucky and his team of contingency lawyers have attempted to seize 141 domain names belonging to internet casinos that do not only not belong to Beshear but are completely outside of his jurisdiction. The case has waffled between appeal courts, twisted and turned, and hopefully, has been pushed to one of the very last attempts by the Kentucky team.

The latest attempt sees Beshear’s legal team braving on a new angle, as the two year case continues to refuse to die. As the Kentucky Supreme Court prepares to issue a final decision on the lawsuit, the team has focused its attack on one online casino company in particular – that of Pocket Kings, the parent company that owns Full Tilt Poker, the world’s second largest provider of internet poker.

Had Beshear been able to successfully seize the 141 domain names originally in question, it would have meant millions in income for the state of Kentucky. No one in the online gambling industry was fooled into actually believing that Beshear wants to protect his constituents from the dangers of gambling; seizing the successful sites would mean that Beshear would come into control of millions, even billions, of dollars in revenue for his destitute region.

That still being the goal, the lawyers have now decided to go after the money directly, by suing Pocket Kings for monies lost by Kentucky residents to their internet casino. A filing has been made with the Franklin Circuit Court, by the Secretary J. Michael Brown, for the Kentucky Justice and Public Safety Cabinet. Said filing requests the restitution of funds lost by residents from March 25, 2005 and September 25, 2009. The new lawsuit is interesting a number of ways, besides the head-shaking element of the desperation.

For one, the lawsuit also hold blame against a list of other online gambling firms that they say “acted in concert in joint ventures to facilitate, host, operate, and profit from online gambling businesses,” including major brands such as Absolute Poker, UltimateBet.com, Bugsys Club, Cake Poker, Crazy Poker, Doyles Room, Golden Palace, Microgaming, My Sportsbook, Pitbull Poker, Players Only, Poker Host, Poker Stars, Poker Time, Red Star Poker, Reefer Poker, Sportsbook.com, True Poker, and WSEX, all groups that have associated with Full Tilt. They miss an entire slew of companies that openly accept players from the US, seemingly picking and choosing which potential victims might be the most likely to bleed money for the state of Kentucky.
