The prohibition of online gambling on a federal level in the United States has been solely identified as the restrictions enacted by the passage of the Unlawful Internet Gambling Enforcement Act in 2006. The law doesn’t identify individuals or even the online casinos themselves as criminal in the use of internet casinos, instead holding the financial entities responsible for processing the transactions. On a state level, however different provinces are able to make their own laws, including punishing specific individuals for use if they so choose.

This week an unfortunate bill has been introduced into the Massachusetts legislature that does just that. It had been hoped that the bill, which was written with the intent to introduce two land based casinos into the state would overlook the online gambling industry, wishes that were destroyed this week as the House Speaker Robert DeLeo presented the bill to his fellow leaders. Not only was the consideration of internet gambling made, but the penalty for Massachusetts residents who choose to continue using online casinos is quite steep.

The bill, totaling 172 pages, reads, “Any person who knowingly transmits or receives a wager of any type by any telecommunication device, including telephone, cellular phone, internet, local area network… or knowingly installs or maintains said device or equipment for the transmission or receipt of wagering information shall be punished” on page 123. The penalty is also included in the proposal, mandating that those convicted of such an offense could be liable to spend as many as 2 years in prison, in addition to paying a $25,000 fine.

Ironically, the only exception made in the bill will be for law enforcement officials themselves, providing that they are betting online in the course of their duties. It’s a blanket prohibition, specifying those within the State, transferring money to or from the State, and any other relation to the State of Massachusetts. No information as yet become available on the likelihood – or not – of the proposal’s chances at passage.
