continued from Beshear Likely to Fail - 1 By commonwealth, she’s referring to the State of Kentucky, meaning the money would come directly into Beshear’s influence in the end. The governor’s office agreed, admitting to ABC that not one individual would come into contact with one cent, sending sparks flying in the online gambling community as players realize that Beshear is using the popularity of the internet casino industry and the law to seize from his own citizens money that he has no right to, just to fill the gap’s in his state’s budget. Other states, already unfriendly to the online gambling world, are now looking through their own books, wondering if a similar plan might work for them. Of course, Beshear will have to win the case first. Professor I Nelson Rose opined that despite the creativity executed by Beshear legal team – who are all working on the contingency that they win in order to get paid – there are major pitfalls in their theory as well. A respected legal expert especially as it applies to the online gambling markets, Rose said that they were using a very antiquated law to file the suit, taking advantage of a mandate that was written when all types of gambling was illegal, and computers didn’t even exist. At the very least, it’s hypocritical that the move is coming from Kentucky, the largest horse racing state in the country, which sets a dangerous precedent for the future. If they should win, it will give the rights to citizens to sue for their own losses in other gambling institutions, such as the races, or even the lottery. No doubt sensing the danger, even the Attorney General of Kentucky refused to take on the case, despite the fact that he was specifically asked to review it by the Governor’s office. "The governor is running a strange campaign," Rose said. "And they couldn't even get the state attorney general to go along with it, so hired a private firm." Attorney General Jack Conway and his office refused to comment. |
